Terms of service
Last updated 12 October 2026. These terms are a contract between you and Henry Kubik-Jones trading as TraceLead ("TraceLead", "we"). TraceLead is a service for businesses: by accepting these terms you confirm you are acting for a business, not as a consumer.
1. The service
TraceLead provides a JavaScript snippet that records first-touch marketing attribution in a visitor's browser, writes it into form fields you choose, and, after consent, reports pseudonymous sessions and lead events to a dashboard. We do not store your leads' personal data.
2. Your account and acceptable use
- You may only install the snippet on websites you own or are authorised to manage, and only on the domains you register.
- You are the controller for your visitors' data. You must obtain any consent the law requires before the snippet stores or sends anything, and configure the consent mode accordingly. The "assumed" consent mode is your declaration that a legal basis exists.
- You must not use TraceLead to collect special-category data, on websites directed at children, to track people across sites you do not control, or to circumvent browser privacy controls.
- You must not scrape, overload or probe the service, get around plan limits, use one organisation's site identifiers on another organisation's websites, or resell the service except as an agency managing your clients' sites.
- Keep your account credentials secure and tell us promptly about any unauthorised use. You are responsible for what members of your organisation do in it.
3. Processing terms
Where we process your visitors' personal data, we do so as your processor and these processing terms apply. They form the data processing agreement between us under Article 28 of the UK GDPR.
- What we process. The pseudonymous visitor and session identifiers, page paths, form identifiers, attribution and engagement counts described in our privacy policy, about visitors to your websites, to show you traffic and leads by channel. We process it for as long as you use the service and then as set out under deletion below.
- Your instructions. We process it only on your documented instructions, which are these terms and the settings you choose in the dashboard. We will tell you if we think an instruction breaks data protection law.
- Confidentiality and security. TraceLead is run by one person, its operator, who is the only person with access to it; anyone we engage in future will be bound to confidentiality. We keep appropriate technical and organisational measures in place, including encryption in transit, access limited to the operator, and an allowlist that drops anything the snippet sends beyond the fields in the privacy policy.
- Sub-processors. You authorise the sub-processors listed in the privacy policy. We will tell account owners by email at least 30 days before adding or replacing one; if you object on reasonable data protection grounds and we cannot address it, you may cancel and we will refund any prepaid fees for the unused period. We impose the same data protection obligations on each sub-processor and remain responsible for them.
- Transfers. Any transfer outside the UK uses the safeguards described in the privacy policy.
- Assistance. We help you, taking into account what we hold, with visitors' rights requests, security, breach notifications and data protection impact assessments. Because we hold no names or contact details, most requests are answered from your own systems.
- Breaches. We will tell you without undue delay after becoming aware of a personal data breach affecting your visitors' data, with the information we have.
- Deletion. Collected data is deleted on the retention schedule you set per site, and all of it 90 days after your organisation is closed, unless the law requires us to keep it.
- Audits. We make available the information needed to show we meet these terms. On reasonable notice, at most once a year unless a regulator requires otherwise, we will answer a written audit questionnaire; on-site audits are by agreement.
4. Free trial
New organisations get a 14-day trial. We do not ask for a card to start a trial and the trial never turns into a paid plan on its own. When it ends, the snippet stops being served until you choose a plan.
5. Plans and payment
Plans are billed in advance through Stripe, monthly or yearly, at the price shown when you subscribe, plus VAT where it applies. Subscriptions renew automatically at the end of each period until you cancel. You can cancel at any time in the billing portal; you keep access until the end of the period you have paid for and the plan does not renew. A yearly plan is a commitment for the year: cancelling stops the next renewal but does not refund the rest of the year. We may change prices with at least 30 days' notice by email, and a new price applies from your next renewal after the notice ends. Fees are non-refundable except where these terms or the law say otherwise. If a payment fails, we will tell you and may pause your sites until it is paid.
6. Availability and changes to the service
We aim for high availability but do not guarantee uninterrupted service. The snippet is designed never to block your forms, even when our servers are unreachable. We may change features with reasonable notice and will not materially reduce the service you pay for during a paid period.
7. Intellectual property and feedback
We own the service and the snippet. You own your data and grant us a licence to process it only to provide the service. You may not copy, reverse engineer or resell the service except as these terms allow. If you send us suggestions, we may use them without obligation to you. We will not name you or use your logo as a customer without your written permission.
8. Warranties
We will provide the service with reasonable skill and care. Beyond that, and to the extent the law allows, the service is provided as it is and as available: we do not promise that it will be uninterrupted or error-free, that every visitor's source can be identified (blocked storage, missing consent and untagged links all leave gaps), or that it will meet requirements you have not told us about.
9. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited by law.
Subject to that, neither of us is liable to the other for loss of profits, revenue, business, goodwill or anticipated savings, or for any indirect or consequential loss. Our total liability to you arising out of or in connection with these terms, in contract, tort (including negligence) or otherwise, is limited to the fees you paid us in the 12 months before the event giving rise to the claim.
10. Indemnity
You will compensate us for reasonable losses, costs and fines we incur from a claim or regulatory action by a third party that results from your breach of section 2, from operating the snippet on your websites without a legal basis you were responsible for, or from the content of your websites. We will tell you promptly about any such claim and let you take part in its defence.
11. Termination
You may close your account at any time. We may suspend or close accounts that seriously breach these terms or do not pay, giving notice first unless the breach puts other customers or visitors at risk. On termination your sites stop being served, collected data is deleted as set out in section 3, and 90 days after closure your organisation and its settings are deleted. Invoices stay in our Stripe account for as long as tax law requires.
12. Changes to these terms
We may update these terms. For a material change we will email account owners at least 30 days before it takes effect. If you do not accept a change, you may cancel before it takes effect and we will refund any prepaid fees for the period after that date; continuing to use the service afterwards means you accept it.
13. General
These terms, with the privacy policy, are the whole agreement between us about the service. If any part is unenforceable the rest stands. Neither of us may transfer these terms without the other's consent, except that we may transfer them to a buyer of the business who takes on our obligations. No one else has rights under them. We will first try to settle any dispute by talking to you; these terms are governed by the laws of England and Wales and the courts of England and Wales have exclusive jurisdiction. 14. Independence
TraceLead is an independent product. It is not affiliated with, endorsed by or connected to any other attribution vendor, and no such vendor's code, branding or materials are used in the service.
